Rental Equipment Agreement

Boat and Equipment Rental Agreement between Cool Waters Kayaks, herein called “Lessor,” and the derringer, herein called, “renter.” This agreement also constitutes a Waiver and Release of Liability whereby the renter agrees to release, discharge, hold harmless, defend, and indemnify Cool Waters Kayaks, and its Owners, Agents, Offices, and Employees from any and all claims, actions, or losses for bodily injury, property damage, wrongful death, loss of services, or whatever may otherwise arise out of Renters use of pontoon boat. By signing this document, the Renter acknowledges he/she specifically understands he/she (renter) is releasing, discharging, and waiving any claims or actions that I may have at the present time, or in the future for the negligent acts, omissions, or other conduct by the owners, agents, offices, or employees of Cool Waters Kayaks. Please initial each item and sign below to acknowledge acceptance of this agreement.

__ Renter shall obey all state, federal, and local boating regulations, laws, ordinances, and lawful derivatives from appropriate emergency or law enforcement personnel while operating or renting boats or equipment from Cool Waters Kayaks. Renter is solely responsible for any citation or violation occurring during the use of, or as a result, using rental boats or equipment from Cool Waters Kayaks.

__ Renter represents that he/she is capable of safely operating and handling the equipment and finds it in good working condition, order, and repair. Renter represents that he/she has adequate skills, Knowledge, and experience to safely complete the planned activity and that adequate preparations have been made to ensure safe completion of the trip.

__ Renter shall bear all risk and responsibility for any and all damages, loss, or theft of the rental boats and/or equipment, or any portions thereof, including, but not limited to vandalism or theft, and shall pay the lessor (Cool Waters Kayaks) the full cost of repair or replacement. __ RECOGNITION OF RISK: Renter expressly acknowledges that boating is an activity with an inherent risk of injury to person and property. RENTER IS AWARE OF THOSE RISKS AND UNDERSTANDS THEM. Renter acknowledges that PFD’s (life jackets) are made available and that ALL RENTERS ARE REQUIRED TO WEAR pfd’s/LIFE JACKETS WHILE USING RENTAL BOATS AND EQUIPMENT. Renter understands that use of PFD does not remove all risks of injury. Renter alone has determined the sufficiency of any safety gear or other precautions that Renter decides to take to minimize the risk of the activity. No party related to the lessor, including Owner and Employees, has made any representation regarding the safety of, or the risks of, the activity. RENTER EXPRESSLY ASSUMES THE RISKS OF THE ACTIVITY. No tubing or waterski activity is allowed.

__ RELEASE OF LIABILITY: Renter hereby RELEASES Lessor (Cool Waters Kayaks) its owners and employees from liability for negligence and HOLDS HARMLESS the Lessor, its owner, and its employees from any loss, expense, or cost, including attorney fees, arising out of any damages or injuries, whether to persons or property, occurring as a result of the rental use of said boat.

__ This agreement constitutes the entire agreement between Lessor and Renter and no term may be waived or modified or implies, by Lessor or Renter, except as contained herein, and Lessor shall not be liable for any loss or injury to renter nor anyone else, of any kind or however caused. This agreement is one of bailment only and Renter is not Lessor’s agent while using said boat or equipment. The law of the State of Florida shall govern this agreement.

__ (Only applicable for Kayak Rental) I acknowledge that I forfeit my kayak rental and money spent if I am more than 15 minutes late [without contact] to the departure ramp. __ (Only applicable for Pontoon Rentals) I understand that any rental within scalloping season (July-September) is non-refundable.

__ (Only applicable for Pontoon Rentals WITHIN SCALLOPING SEASON) I agree that should the dates of my reservation need to be changed I will be charged a $100 transfer fee subject to availability.

__ (Only applicable for MULTI-DAY Kayaks and Pontoon Rentals) I agree to a $500 refundable damage deposit on all multi-day rentals. This charge will be refunded within 24hrs after the return of the rental. This 24hr timeline allows for a thorough inspection of the vessel to assess for damages. Multi day Pontoons need to be returned with a FULL tank of fuel or renter will charged the amount it takes to fill.

__ (Only applicable for SINGLE DAY Pontoon Rentals) I agree to a $500 credit card hold for any single-day boat rentals This hold will be released within 24hrs after the return of the rental. This 24hr timeline allows for a thorough inspection of the vessel to assess for damages. __ (Only applicable for Pontoon Rentals) I agree to immediately contact Cool Waters Kayaks if the boat malfunctions in any way during the duration of my rental.

__ Renter agrees not to operate any motorized boat during a Small Craft Advisory. Please become familiar with weather apps and marine websites such as: safeboater.com, boatsetter.com, boaterpal.com, boatus.org, weather.gov, thehulltruth.com, tides4fishing.com for current weather forecasts as well as Florida boating rules and safety regulations.

Non-compliance with the above agreement may result in charges for loss or damage. I have

read and understand the above. I agree to the terms and conditions as stated.

Late Fees: We adjust our entire delivery schedule and work hours around the assigned return time. Please allow EXTRA time to account for busy boat traffic and or weather. - There will be a charge of $1.00 per minute late, with a MINIMUM charge of $50.00.

• Please be ON TIME!
• For the boat rental, there will be a minimum $150.00 charge for running out of gas if pickup is required. The fee will be increased depending on mileage/distance away.
